If you do not agree with any part of these Terms, you must not use our services. By proceeding with a booking or making payment, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Definitions & Interpretation

  • "Student," "You," "Your," "Client": The person booking and receiving driving instruction services.
  • "Services": All driving instruction, theory test preparation, practical test preparation, ADI training, and related services we provide.
  • "Instructor": DVSA-approved driving instructors employed by or contracted with ClearDrive UK.
  • "Lesson": A period of driving instruction, typically lasting 1-2 hours unless otherwise specified.
  • "Package": A pre-paid block of lessons purchased at a discounted rate.
  • "Test": The DVSA practical driving test or theory test.

  • "DVSA": Driver and Vehicle Standards Agency, the UK government body responsible for driving standards.
  • "Working Day": Monday to Friday, excluding UK public holidays and bank holidays.

5. Eligibility & Legal Requirements

5.1 Minimum Age Requirements

  • You must be at least 17 years old to take car driving lessons (16 for certain disability benefits)

5.2 Driving Licence Requirements

You MUST possess one of the following:

  • A valid UK provisional driving licence
  • A valid UK full driving licence (for additional categories or refresher lessons)
  • A valid overseas driving licence with appropriate UK driving entitlement

⚠️ LEGAL REQUIREMENT: Driving without a valid licence is a criminal offence. You MUST present your licence to your instructor before your first lesson. Failure to possess a valid licence will result in immediate lesson cancellation with full charges applied.

5.3 Medical Fitness

You must:

  • Meet the DVSA medical standards for driving
  • Declare any medical conditions that may affect your ability to drive safely
  • Inform us immediately of any changes to your medical condition or fitness to drive
  • Follow any medical restrictions noted on your driving licence

5.4 Eyesight Requirements

You must be able to read a number plate from 20 metres. If you require glasses or contact lenses to meet this standard, you must wear them during all lessons and your driving test.

6. Booking Process

6.1 How to Book

6.2 Booking Confirmation

A booking is confirmed when:

7. Payment Terms & Pricing

7.1 Pricing

  • All prices are displayed on our website and are subject to change
  • Prices are in British Pounds Sterling (GBP) and include VAT where applicable
  • Current pricing applies at the time of booking; changes do not affect existing bookings
  • Special offers and promotional pricing have terms specified at the time of offer

7.2 Payment Methods

7.3 Payment Timing

7.4 Lesson Packages & Blocks

Pre-paid lesson packages:

  • Unused lessons after 12 months may be forfeited or require renewal fee

7.5 Additional Charges

Additional charges may apply for:

  • Lessons on bank holidays or outside standard hours (surcharges specified when booking)
  • Excessive travel distance (if pickup location exceeds normal service area)
  • Test day accompaniment services
  • Vehicle hire for driving test (where applicable)
  • Late cancellation or no-show fees

8. Cancellation & Rescheduling Policy

⚠️ IMPORTANT: Our cancellation policy is strictly enforced to ensure fairness to instructors and other students. Please read carefully.

  • Bereavement
  • Serious family emergency
  • Extreme weather conditions making travel unsafe

We will consider waiving cancellation charges on a case-by-case basis. Contact us as soon as possible to discuss.

8.4 Cancellation by Us

We reserve the right to cancel lessons due to:

  • Instructor illness or emergency
  • Vehicle breakdown or maintenance issues
  • Adverse weather conditions (snow, ice, severe storms)
  • Student arriving under the influence of alcohol or drugs
  • Student behavior that compromises safety
  • Operational requirements

In such cases, we will:

  • Notify you as soon as reasonably possible
  • Offer a full refund or alternative lesson time
  • Attempt to provide an alternative instructor where possible

Liability: We are not liable for any consequential losses resulting from cancelled lessons, including lost wages, travel expenses, or test fees.

8.5 Refund Processing

Approved refunds will be processed within 14 working days via the original payment method.

9. Your Responsibilities as a Student

As a student, you agree to:

9.1 Documentation

  • Present a valid driving licence before your first lesson
  • Carry your licence photocard and counterpart (if applicable) to every lesson
  • Provide your National Insurance number when required for licence verification
  • Notify us immediately of any licence endorsements, bans, or revocations

9.2 Punctuality & Attendance

  • Be ready at the agreed pickup location at the scheduled time
  • Notify us immediately if you will be late (lessons may be shortened if delayed)
  • Understand that late arrival may result in reduced lesson time
  • Lesson time starts at the scheduled appointment time, not when you arrive

9.3 Fitness to Drive

  • Arrive sober and free from any substances that impair driving ability
  • Be well-rested and fit to drive (lessons may be refused if you appear unfit)
  • Wear appropriate footwear (no flip-flops, high heels, or unsuitable shoes)
  • Inform your instructor if you feel unwell during a lesson

9.4 Behavior & Conduct

  • Treat instructors and staff with respect at all times
  • Follow all instructions from your instructor during lessons
  • Maintain appropriate professional boundaries
  • Keep the vehicle clean and respect the learning environment
  • Not eat, drink, or smoke in the vehicle without instructor permission

9.5 Practice & Learning

  • Engage actively in lessons and complete any recommended practice or homework
  • Inform your instructor of any private practice you're undertaking
  • Be honest about your confidence levels and any concerns
  • Practice between lessons where safely possible with a qualified supervisor

⚠️ Zero Tolerance: We operate a zero-tolerance policy for students who arrive under the influence of alcohol, drugs, or other substances. Lessons will be immediately terminated with full charges applied and may result in termination of services.

10. Our Obligations to You

ClearDrive UK commits to:

  • Provide DVSA-approved, qualified instructors for all lessons
  • Maintain vehicles to high safety and comfort standards
  • Ensure all vehicles are fully insured for driving instruction
  • Deliver lessons professionally and courteously
  • Provide honest assessment of your driving progress
  • Only recommend your driving test when we believe you're ready
  • Maintain confidentiality of your personal information
  • Handle complaints fairly and promptly
  • Provide receipts for all payments
  • Keep accurate records of your lesson history and progress

11. Instructor Standards & Qualifications

All our instructors:

  • Are fully DVSA-approved (ADI qualified)
  • Display valid green ADI badges in vehicles
  • Hold enhanced DBS (Disclosure and Barring Service) checks
  • Are covered by comprehensive business insurance
  • Undergo regular continuing professional development (CPD)
  • Maintain standards check ratings as required by DVSA
  • Follow DVSA code of practice and our internal standards

12. Vehicles & Insurance Coverage

12.1 Vehicle Standards

All instruction vehicles:

  • Are maintained to manufacturer specifications
  • Have valid MOT certificates (where applicable)
  • Are fitted with dual controls for safety
  • Are clean, comfortable, and roadworthy
  • Meet DVSA requirements for driving tests

12.2 Insurance Coverage

During lessons, you are covered by our comprehensive motor trade insurance policy which includes:

  • Third-party liability coverage
  • Comprehensive cover for the instruction vehicle
  • Public liability insurance
  • Employer's liability insurance

12.3 Damage & Liability

Our insurance covers accidental damage during normal instruction. However:

  • You may be liable for excess charges (typically £250-£500) if an incident occurs due to your actions
  • Deliberate or reckless damage will result in full liability and potential legal action
  • Failure to follow instructor directions that results in damage may incur charges

12.4 Personal Belongings

We are not liable for loss or damage to personal belongings left in vehicles. Please take all valuables with you when leaving the vehicle.

13. Driving Tests & Test Preparation

13.1 Test Booking

Booking your driving test is your responsibility. We can:

  • Advise you when we believe you're ready for your test
  • Recommend suitable test centers and times
  • Assist with the booking process if requested
  • Book tests on your behalf (additional fee may apply)

13.2 Test Day Services

We offer:

  • Pre-test warm-up lessons (highly recommended)
  • Vehicle hire for your test
  • Transportation to and from the test center
  • Instructor accompaniment and support

13.3 Test Outcomes

Important Disclaimer: We cannot guarantee you will pass your driving test. Pass rates depend on your individual ability, practice, preparation, and performance on the day. Test fees paid to DVSA are non-refundable regardless of outcome.

13.4 Test Cancellation by Student

If you cancel test day services:

  • 48+ hours notice: Full refund of our services (DVSA test fee non-refundable)
  • Less than 48 hours: Full charge for vehicle hire and instructor time

14. Lesson Duration & Timing

14.1 Standard Lesson Times

  • Lessons are typically 1 or 2 hours in duration
  • Intensive courses may involve longer sessions (4-6 hours with breaks)
  • Lesson time includes pickup and drop-off within a reasonable service area
  • Time spent traveling to/from test centers counts as lesson time

14.2 Lesson Start & End Times

Lessons begin at the scheduled appointment time, not when the instructor arrives or you enter the vehicle. Similarly, lessons end at the scheduled finish time. Late arrival by students will result in proportionally shorter lessons.

14.3 Traffic & Delays

Driving lesson time includes all time spent in traffic, at traffic lights, or in congestion. We cannot extend lessons or provide refunds due to traffic conditions as this is part of real-world driving experience.

15. Progress Tracking & Assessment

We provide:

  • Regular feedback on your driving progress
  • Written or digital progress records (where provided)
  • Honest assessment of skills requiring development
  • Estimated timeline to test readiness (subject to individual progress)
  • Access to online progress tracking (where available)

Progress timelines are estimates only and depend on individual ability, practice between lessons, and lesson frequency.

16. Safeguarding Policy

We are committed to safeguarding all students, particularly those under 18 and vulnerable adults.

16.1 Young Learners (Under 18)

  • Parents/guardians must be informed of lesson schedules
  • Pickup and drop-off locations must be safe and approved
  • Parents/guardians have the right to contact instructors regarding progress
  • All instructors hold enhanced DBS checks

16.2 Professional Boundaries

Instructors will:

  • Maintain professional relationships at all times
  • Not engage in personal relationships with students
  • Report any safeguarding concerns appropriately
  • Respect privacy while maintaining appropriate supervision

17. Behavioral Standards & Misconduct

17.1 Unacceptable Behavior

We reserve the right to terminate services immediately without refund for:

  • Abusive, threatening, or aggressive behavior
  • Sexual harassment or inappropriate conduct
  • Discrimination or hate speech
  • Arriving under the influence of alcohol or drugs
  • Reckless or dangerous driving actions
  • Deliberate damage to vehicles or property
  • Persistent lateness or no-shows
  • Failure to pay for services

17.2 Consequences

Serious misconduct may result in:

  • Immediate termination of lesson without refund
  • Ban from using our services
  • Forfeiture of any pre-paid lessons
  • Reporting to police (where appropriate)
  • Legal action for damages or losses incurred

18. Liability & Limitations

18.1 Our Liability to You

We are liable for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Breaches of statutory rights that cannot be excluded

To the extent permitted by law, we are NOT liable for:

  • Loss of earnings or wages due to missed lessons
  • Test fees if you fail your driving test
  • Travel expenses incurred attending lessons
  • Consequential losses from cancelled or delayed lessons
  • Loss or damage to personal belongings
  • Events outside our reasonable control (force majeure)

18.3 Maximum Liability

Where we are liable, our maximum liability is limited to the total amount paid by you for the specific services giving rise to the claim.

If any provision is found to be invalid or unenforceable, the remaining provisions shall continue in full force.
